This License Agreement (“Agreement”) governs the use of software provided by The Plugify (“we”, “us”, or “our”) and any associated documentation made available through our website theplugify.com (the “Site”).
Subject to the terms and conditions of this Agreement, we grant you a limited, non-exclusive, non-transferable license to use the software provided by us for your personal or commercial purposes. This license is granted solely for the purpose of accessing and using the software in accordance with this Agreement.
You may not:
- Modify, adapt, translate, reverse engineer, decompile, or disassemble the software.
- Distribute, sublicense, lease, rent, or loan the software to any third party.
- Remove or alter any copyright, trademark, or other proprietary notices contained in the software or documentation.
- Use the software in any manner that violates applicable laws or regulations.
The software and all intellectual property rights therein are and shall remain the exclusive property of The Plugify and its licensors. This Agreement does not convey to you any rights of ownership in the software or any intellectual property rights associated therewith.
This Agreement is effective upon your acceptance and will remain in effect until terminated by either party. You may terminate this Agreement at any time by ceasing to use the software and destroying all copies thereof in your possession. We may terminate this Agreement immediately if you breach any provision of this Agreement.
The software is provided “as is” without warranty of any kind, express or implied. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall we be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the software, even if we have been advised of the possibility of such damages.
This Agreement shall be governed by and construed in accordance with the laws of Germany. Any dispute arising under this Agreement shall be resolved exclusively in the courts of Germany.
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral, relating to such subject matter.
